Abstract: Should the man who started a criminal act, thereafter abandoned his criminal intent and stopped the criminal act be punished more lenient or not than the case of ordinary attempted crimes? In this country and Germany etc., he is treated leniently in accordance with the Criminal Law. This paper deals with the controvercial problems as follows. To what extent should the voluntariness relating to the abandonment of criminal intent be required? When should the execution of a criminal act be concluded? How sincerely should efforts to prevent the occurrence of damages be made? Is it conceivable to stop the preparation (Rucktritt von der Vorbereitung)? Moreover, many judicial precedents are investigated on this case.
